1. Agreement to Terms
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and MASSTRAFFIC CO ("we," "us," or "our"), concerning your access to and use of masstraffic.co(the "Site") as well as any other media form, media channel, mobile website, or software application related, linked, or otherwise connected thereto.
By accessing the Site, you acknowledge that you have read, understood, and agreed to be bound by all of these Terms of Service. If you do not agree with all of these Terms of Service, then you are expressly prohibited from using the Site and our services, and you must discontinue use immediately.
2. Intellectual Property Rights
Unless otherwise indicated, the Site and its original content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by MASSTRAFFIC CO, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site strictly for personal or internal business research purposes in accordance with these Terms.
3. The MassTraffic Client Ownership Model
Asset Transfer & Code Ownership
MassTraffic builds custom digital assets that our clients own. Upon final project completion, full clearance of invoices, and deployment:
- We transfer 100% of the custom codebase, page content, database tables, and automated scripts to you.
- We transfer hosting subscription keys, domain registries, and server credentials to accounts owned solely by you.
- You maintain full rights to edit, scale, replicate, or delete the code. No vanity contracts, block-in licensing fees, or rental traps.
*Third-party software libraries, open-source frameworks (such as Next.js, React, Tailwind), and API integrations are subject to their respective open-source or commercial license agreements.
4. Prohibited Activities
You may not access or use the Site for any purpose other than that for which we make the Site and services available. Prohibited activities include:
- Systematically retrieving data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission.
- Attempting to bypass, disable, or interfere with security-related features of the Site or our API-driven performance analyzers.
- Using the Site or our custom quote forms to distribute unsolicited advertisements, spam, or malicious payloads.
- Engaging in automated scraping, data mining, or using extraction tools on our educational and operational pages.
5. Disclaimers & Limitation of Liability
THE SITE AND SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SITE AND OUR TOOLS IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF.
WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SITE'S CONTENT OR THE CONTENT OF ANY WEBSITES LINKED TO THE SITE. WE WILL ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY (1) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT AND MATERIALS, (2) PERSONAL INJURY OR PROPERTY DAMAGE OF ANY NATURE RESULTING FROM YOUR ACCESS TO AND USE OF THE SITE, OR (3) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE SITE BY ANY THIRD PARTY.
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE OR CUSTOM CODEBASES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
6. Governing Law
These Terms of Service and your use of the Site and services are governed by and construed in accordance with the laws of the **State of Iowa**, without regard to its conflict of law principles.
